Terms & Conditions 

For Courses, Events and Expeditions held outside the UK, including Nepal 

Nomad Mountaineering & Events Ltd are a UK based Adventure Company and for clients to book trips with local guides abroad as well as operating their own ‘in house’ UK Based Expeditions.

These Terms and Conditions apply specifically to overseas Expeditions and do not cover activities managed directly with Nomad Mountaineering & Events Ltd which take place in the United Kingdom.

When you make a booking for an overseas expedition, you are also accepting the overseas hosts booking terms and conditions, which we'll make available to you at the time. Make sure you check those terms. We highly recommend travel insurance for all overseas trips, and be sure to check it covers the activities that the trip you are booking includes; often this is also a requirement for your trip.

Whilst Nomad Mountaineering oversees the administration and content of this website we do rely on our hosts providing us with up to date and accurate content. Such content is the responsibility of the third party host and we cannot give any guarantee or assurances regarding the reliability and accuracy of the content and information provided. The information provided may contain errors, inaccuracies, typos and omissions or be out of date at any given time so we suggest you cross check all information fully with the third party host directly.

Nomad Mountaineering strives to endorse, partner and collaborate with companies and third  parties which adhere to the highest professional standards but we do not offer or guarantee the ethical professional or safety standards of a third party host.

Where we offer a link to a host website, the pages contained therein are the sole responsibility of each supplier and should not be considered an endorsement by us to them or them to us unless expressly started otherwise.

Participation Requirements

All participants must be over 18 and confident that they meet the trip requirements as stated.

When you access www.nomad-mountaineering.com (‘this Website’), to book an overseas/Non-United Kingdom expedition UK or use any service offered by us on it (the “service”) you are accepting the following terms. They apply to you, the user’.

In the event of any conflict between the hosts terms and conditions and these booking conditions, the conditions of Nomad Mountaineering will apply in respect of that difference.

Participation Statement

We ask you to read and understand the following participation statement,

Climbing, Mountaineering and High Altitude Trekking along with any associated adventure sports such as Kayaking and Mountain Biking are activities with a danger of personal injury or death. As a participant in any of these activities you should accept and be aware of the level of risk and exercise your own judgement as to fitness, experience, skill level and suitability. In doing so you accept personal liability for participating in any such activity.

This statement does not prejudice a host’s decision to remove you from a trip or excursion where fitness and personal ability is deemed insufficient enough as to pose a safety concern

Article 3: Service Provision

Nomad Mountaineering verify and check expertise and resources available from local guides, tour operators, hosts, accommodation and other associated travel requirements (‘Hosts’) globally.

Should you make an overseas booking, your booking contract is with the Hosts named on the site and on your booking confirmation emails and is also subject to its terms and conditions. It is your responsibility to check these prior to entering into any agreement.

Nomad Mountaineering undertake a level of due diligence of the hosts including but not limited to checking all relevant permits and licences, qualifications and levels of expertise and training but we cannot warrant any of the trips, products or services sold by any of our hosts and therefore cannot be held responsible or liable for monetary losses, injuries or damages to persons or property arising from any activities undertaken by the host. Nomad Mountaineering therefore assumes no responsibility or liability for any damage, loss or injury arising at any time out activities carried out by a host including but not limited to malpractice, negligence or otherwise and including all products and services offered by a host. Information given by any host, either through this Website or otherwise, regarding their products and services is the responsibility of the host and the host is solely responsible for their products and services, therefore the terms and conditions of the host of your confirmed arrangements will apply to your booking. It is your responsibility to check these prior to booking and whether any restrictions or indemnities may apply to your booking.

Article 4: Payments and Cancellations

When booking with Nomad you are directed to a secure online checkout that allows payment by credit or debit card.

On receipt of Deposit/Initial Payment you will receive an email confirming your booking.

Cancellations & Chargebacks

If you Cancel

If you need to cancel you may incur cancellation fees. Please note that deposits are always non-refundable and cancellation terms are as follows:

Cancellation by:    Terms:

Less than 2 months to Day One of Itinerary   No refund

2 months or more to Day One of Itinerary  100% less deposit

Failure to pay full amount within 14 days   No refund

of final amount being owed

If a Chargeback is raised by you via your bank or card issuer then Nomad will consider the booking as cancelled in line with the above terms. Nomad Mountaineering may elect to dispute the Chargeback via the prescribed channels offered by the payment provider.

The Chargeback Process can take approximately 40 to 50 calendar days to reach a conclusion and in certain circumstances, longer. Under no circumstances can a booking be altered, amended or cancelled whilst an unsettled Chargeback is in progress and payment and cancellation dates will still apply. Customers may not make any new bookings whilst a Chargeback is in dispute. Where such disputes are found to be in favour of Nomad Mountaineering,we will pass on to the you “the customer all Chargeback fees levied against us along with an administrative charge of £250 (which ever is greater)

Your obligations and responsibilities:

- You must complete all required excursion paperwork by the required date given at the time of booking. Failure to complete and return required information may be deemed a cancellation in line with the above terms.

- We recommend that you take out Travel Insurance which includes Trip Cancellation Cover so you may reclaim any charges levied by us

- We do reserve the right to charge an additional administration fee of 8% of any amount refunded

- Requests for date changes may be deemed as a cancellation if no suitable alternative can be found.

- We accept no responsibility for bookings made where fitness and skill requirements cannot be met. In these instances, the host has absolute right to remove you from the Excursion should there be any concern over levels of fitness, aptitude or any other factors which may be deemed covered by safety considerations. In these instances no refund will be given.

- You are responsible for your International Travel and arrival and departure to the nominated destination provided on the itinerary. The host is contractually obliged to meet and drop off from this destination only on the basis of the travel and flight information you supply. There is no obligation on behalf of the host to adjust significantly any of the expedition based on disrupted travel. We accept no responsibility for any or all parts of the excursion being missed by travel disruption.

- Like any adventure sport, your participation carries a degree of risk to your possessions, personal injury and death. Always ensure you are fully aware of the risks your participation as you assume full responsibility for this risk. Whether connected to activities offered via this website or unconnected to activities offered by this website we assume no liability for personal protection, personal injury, injury to others, damage of property and possessions of you or others through your participation. We strongly recommend that you have Personal Insurance which covers your activity. For Nepal, this must include helicopter and high altitude trekking provision.

- Whilst Nomad conduct a degree of checks against hosts, we cannot guarantee the validity of qualifications, certifications, experience or suitability of the hosts credentials to conduct and carry out the services they offer.

 
If the overseas host cancels

Nomad Mountaineering and the host do reserve the right to make changes and alternations to services and dates where circumstances deem it necessary. In such circumstances we contact you as soon as we can and you will have the choice of accepting an alternative date where available or cancelling and receiving a full refund from us of all payments made to that date, less deposit which will be issued as vouchers to use against any UK or Global Excursion valid for a further 12 months. We will refund any difference should the alternative be of a lower value.

Nomad Mountaineering accept no liability for additional costs which may be affected, including but not limited to International Flights, additional accommodation, and other associated costs. We strongly suggest that Travel Insurance policies are taken out to cover such instances and advise that the hosts terms and conditions are also read in conjunction with these.

Extraordinary Circumstances & Force Majure

Neither Nomad Mountaineering nor our hosts are liable for any refunds as a result of a cancelled trip though events from which neither party can be held accountable. This includes but is not limited to; natural disasters, warfare and acts of terrorism, civil and political unrest, interference by foreign authorities or governments, destination country being added to an advisory list, labour action and strikes, disease outbreak, ecological and industrial disasters, adverse weather conditions and any other significant risks to human life or health. It also includes the threat of any such eventuality where the travel or residing in the specific destination is deemed unsafe or unsuitable.
